Congress has not only given Trump, or whoever's president, the authority to end the TPS program [temporary protected status for immigrants, legal or not], choose who qualifies and who doesn't, but it explicitly placed that decision beyond judicial review. So how does this [San Francisco] judge get around that? How does this judge get around Congress, which determines the jurisdiction of these courts? Remember, these inferior Article 3 federal courts are not creations of the Constitution. The only court created by Article 3 is the Supreme Court. All the inferior federal courts and all their unelected, black-robed, tyrannical federal trial-court judges are creations of Congress. Congress determines what federal courts will exist and not, which circuits will exist and not, and what jurisdiction these courts have—and do not have. And every one of these courts, despite how they pretend they have infinite and unlimited jurisdiction about everything and everyone all over the world—the universe!—in fact, under Article 3, they only have limited jurisdiction—limited by geography, limited by subject matter, limited by the persons over whom they can wield jurisdiction. And Congress determines the limits of that jurisdiction.
I find all of this both heartening and depressing because, if it's true, then we ought to see a serious clampdown on all of these radical-activist judges overstepping their authority. But since we live in a brazenly post-rule-of-law era, I don't expect that much will be done to enforce what this lawyer is talking about. And that's the real shame.
